I don’t know who I have more compassion for; the guy in the van — who is obviously upset for a lot of reasons — or the police officer!

I put this in the tag of Good Old Days when cops acted like human beings instead of tazering everybody.

A lawsuit brought by an Ohio family whose children were held at SWAT-team gunpoint while their food supplies were confiscated is scheduled to go to trial this week.

John and Jackie Stowers are suing the Ohio Department of Agriculture and the Lorain County General Health District over the raid on their “Manna Storehouse,” an organic food co-op that operated in LaGrange.

The Stowers and their 10 children and grandchildren were detained in one room of their home for six hours while sheriff’s officers confiscated 60 boxes of fresh farm food, computers, phones and records, including USDA-certified meat from the children’s mini-farm, according to lawyers for the plaintiffs.

The state and county are accused of 119 counts, including unlawful search and seizure, illegal use of state police power, taking of private property without compensation, failure to provide due process and equal protection and a multitude of constitutional rights violations, including the right to grow and eat one’s own food and offer it to others.

WND reported when the case developed a year ago.

At that time, a state agent from the Ohio Department of Agriculture pressured the Stowers to “sell” him a dozen eggs, then returned with a SWAT team to detain the family’s children and confiscate food supplies.

The case brought by state and local authorities against the Stowers came to a head Dec. 1, 2008, when police officers used SWAT-style tactics to burst into the home, hold family members, including children, at gunpoint and confiscate the family’s personal food supply.

Two organizations, the Farm-to-Consumer Legal Defense Fund and the Buckeye Institute’s legal arm, the Center for Constitutional Law, initially started working to defend the family.

But now the family is on the offense, accusing the government agencies and their individuals of rights violations.

David Cox, an attorney for the Farm-to-Consumer Legal Defense Fund, confirmed that nothing ever resulted for the family after the confiscation of the food.

There were no charges, “civil, criminal or otherwise,” he said.

In an audio podcast posted online, Maurice Thompson of the Buckeye Institute said the family has run the Manna Storehouse, focusing mainly on organic supplies, for several years near Cleveland.

The confrontation began developing several years ago when local health officials demanded the family hold a retail food license to run their co-op. Thompson said the family wrote a letter questioning the requirement and asking for evidence that would indicate they were operating a food store.

The Stowers family members simply “take orders from (co-op) members … then divide up the food,” Thompson explained.

“The health inspector didn’t like the tone of the letter,” Thompson said, and the result was that law enforcement officials planned, staged and carried out the raid on the family’s home.

The “sale” of the eggs to the undercover agent was entrapment, the family’s lawyers have contended, since the family members had told him they didn’t sell food to the public and couldn’t help him.

Eventually, when he refused to leave, the family gave him a dozen eggs to hasten his departure, Thompson explained.

The case goes to trial Thursday and Friday in Elyria.

Among other things, the case demands the return of the family’s property, as well as an injunction prohibiting enforcement of any licensing requirements of the Ohio Uniform Food Safety Code upon the cooperative.

The case focuses first on the “paramilitary style execution of a search warrant against a peaceful family” whose only alleged crime was not getting a state permit. The second is a challenge to government claims the cooperative is a retail food establishment.

“Between the physical things they took and the emotional and spiritual trauma they caused in our lives, it’s our hope we can somehow help others with this [lawsuit],” Jacqueline Stowers said.

Officials with the Weston A. Price Foundation, a nutrition education non-profit, said several of their members had been participating in the co-op, but now their food supplies are disrupted.

There is mention of the G20 protests. One source says they were “peaceful.” Other sources say they were not; that they were rioting, breaking windows, etc. In that case I would say it was all one big set up, for that is NOT how conservatives protest. But that is exactly how Acorn and other liberal communty organizers work. I find it strange that most if not all the protestors are dressed in black, just as those robocops.

Which leads me to ask why they would do this? I believe it is to try and intimidate any one who would protest in the future while the robocops that came into the crowd with their black uniforms looking like something out of Star Wars. 

Is the military training the police to take on the American people? You decide.

You know, I believe in justice. I believe if someone breaks the law, they should pay the penalty. But I do not believe cops have the right to beat an unarmed 14 year old boy. You mean to tell me, it was not possible for two big burly cops to restrain a young boy or reason with him? Sorry, I do not believe it. Cops are getting way too much power to hurt people. Why do you think that is?

Was this cop wrong?

I get angry when I see unjust police brutality. In this case below, a 72 year old woman was tazered by an officer when she refused to complie with a simple signing of a speeding ticket. 

I can not really fault the officer in this case.

It doesn’t matter that she was 72 years old. Just because someone is 72 does not mean they can not be mean as a snake. How did he know that as rebellious as she was, she did not have a weapon? It looked to me she either knowingly or unknowingly was risking his life by  refusing to stand back, forcing him to be on the expressway.

First, the woman was speeding.

Second, she was expected to sign a ticket. She refused. 

Third, she had him almost out in the expressway. He moved her, not shoved her. She began to challenge him by walking towards him.

She did not complie at all.

She rebelled and was going back to her car.

He stopped her.

She continued to be a pain in the butt.

She even dared him!

He tazered her.

Cop was right. She was wrong.

I hope the cop wins.

Warning to America: Will you be next?

Pastor Steve Anderson from Arizona was beaten and tasered by no-count cops for defending his constitutional rights. I urge you to watch and listen to what this man went through. Big Brother is becoming more and more of an uncontrolled beast that abides by it’s own laws. At the end of the video, Steve Anderson asks, “Wake up America. Why is this happening in the United States of America?”

I believe it is happening because of the vile corruptness in high places. I expect to see more of it with this new Washington administration. What can we expect in a nation where evil is being called good and good is being called evil? I hope he will sue the pants off of someone for this grossly unfair injustice.

An Arizona pastor – Tasered, bloodied by broken glass and sporting 11 stitches in his head – claims his injuries came from being stopped at a Border Patrol checkpoint 75 miles inside the U.S. and then being battered by police for refusing to allow agents to search his vehicle.

The incident earlier this week highlights tension between constitutional rights, the issue of border security and a controversial Supreme Court ruling that grants an exceptional level of police authority near the Mexican border.

Pastor Steven Anderson of Faithful Word Baptist Church in Tempe claims he did nothing to deserve his eventual arrest and believes that when he refused to allow the search of his car he was simply standing up for his Fourth Amendment rights, which protect him against unreasonable search without a warrant.

Anderson further questions why the Border Patrol is allowed to stop and search cars at a checkpoint along Interstate 8, 75 miles inland of where the highway nears the Mexican border at Yuma, Ariz.

“I was in the United States! I had crossed no international border!” writes Anderson in commentary accompanying a video he made about his experience.

“I didn’t have any drugs; I didn’t have a human beings in my car,” he claims in the video itself. “Why is this happening in the United States of America?”

The U.S. Border Patrol, however, explained to WND that Anderson misunderstood his constitutional rights and that because a drug-sniffing dog alerted to Anderson’s rental car, the pastor was wrong not to allow the agents to search his vehicle.

Ben Vik, a supervisory Border Patrol agent for the Yuma sector, further told WND that the Supreme Court and federal law permit the Border Patrol to establish checkpoints up to 100 miles inside the U.S. and that with probable cause the Fourth Amendment doesn’t apply to searches of automobiles.

“The Supreme Court found that only minimal intrusion existed to motorists at reasonably located checkpoints,” said Vik. “The Supreme Court found that the very brief detention of motorists at a well-marked and identified immigration checkpoint did not constitute an unreasonable search and seizure.”

Vik’s statement, however, doesn’t apply to typical law enforcement agencies, but – thanks to a controversial ruling – only to “immigration” checkpoints established by the Border Patrol.

The courts have typically ruled against “suspicion-less” stops and searches of vehicles at police checkpoints, such as the one that detained Anderson. As recently as 2000, the Supreme Court ruled in Indianapolis vs. Edmond that police cannot establish roadblocks staffed by dogs to randomly search automobiles for drugs.

“We have never approved a checkpoint program whose primary purpose was to detect evidence of ordinary criminal wrongdoing,” the Supreme Court majority wrote in Indianapolis vs. Edmond. “The [Indianapolis] checkpoints violate the Fourth Amendment.”

The 1976 United States vs. Martinez-Fuerte decision, however, created an exception allowing the Border Patrol the unique power to establish checkpoints for seeking illegal immigrants, with the secondary purpose of finding drugs. So while Yuma-area police cannot operate a K-9, or drug-detecting dog, checkpoint without violating the Fourth Amendment, the Border Patrol can.

A second exception was also created for drunk driving checkpoints under 1990’s Michigan Department of State Police vs. Sitz, but some – including Supreme Court Justice Clarence Thomas – do not believe the exceptions to the Fourth Amendment are warranted.

“I am not convinced that Sitz and Martinez-Fuerte were correctly decided,” Thomas wrote in an opinion on the 2000 Indianapolis vs. Edmond decision. “Indeed, I rather doubt that the framers of the Fourth Amendment would have considered ‘reasonable’ a program of indiscriminate stops of individuals not suspected of wrongdoing.”

Graham Boyd, director of the American Civil Liberties Union’s Drug Law Reform Project in Santa Cruz, Calif., told the Phoenix New Times that an immigration checkpoint is “thin justification” for sniffing random cars for drugs without a warrant.

“Even if somebody has no sympathy for a marijuana user,” Boyd says, “you should still be concerned that the U.S. government is saying the border is an area where the U.S. Constitution is suspended.”

Senior Patrol Agent Vik assured WND that even in the checkpoints, citizens do maintain certain rights limiting officers’ actions.

“Border Patrol immigration checkpoints don’t give Border Patrol agents carte blanche to automatically search persons or their vehicles,” Vik explained. “To conduct a legal search under the Fourth Amendment, agents must develop an articulable probable cause to conduct a lawful search.”

In Anderson’s case, the pastor claims the K-9 dog made no bark or indication that his rental car was tainted with drugs, while Vik insisted to WND that the dog did alert agents to drugs, thus granting probable cause for the search.

Both Anderson and Vik confirm that no contraband was discovered on the vehicle.

As for the Tasering and other alleged rough treatment by police, Vik told WND that Anderson was extracted from his car and arrested by Arizona Department of Public Safety officers, not the Border Patrol, a statement Anderson confirms in his video.

The Arizona DPS told WND that an investigation into the officers’ actions is ongoing and no comment can be made until it is complete.

Anderson spent the evening of his arrest in jail and is awaiting a formal arraignment at which he intends to plead “not guilty.”

Today the city of Oakland, the Bay Area and the entire country say goodbye to four police officers who were murdered by a parolee, no-good street thug. Thousands are expected to attend the funeral of officers killed Saturday: Sgts. Mark Dunakin, 40, of Tracy; Erv Romans, 43, of Danville; and Daniel Sakai, 35, of Castro Valley. Officer John Hege, 41, of Concord, also was shot Saturday and declared brain-dead Sunday. He was taken off life support late Monday.

Lovelle Mixon, the cops’ killer and a suspected child rapist, is now a popular icon in the sick and twisted minds of those who support Mixon’s murderous actions and hate the cops. The other night on TV, a reporter held pictures of Mixon’s victims and some maniacs stepped forward and spit on the photographs. It was sickening, but what do you expect from street punks who take no personal responsibility and worship the likes of Che Guevara, a mass murderer, the Black Panthers,and now Mixon, the pervert and cop killer.

Mixon’s apologists are proud of themselves and are not only spitting on pictures of the officers who died in the line of duty, but they’re marching in the open, videotaping themselves and trying to intimidate folks who don’t believe in their radical lunacy.

I simply commented on the behavior of those from Uhuru who think it’s OK to kill four police officers. I wrote about the Democratic wing of the Uhuru chapter of Oakland (“A Rush to Racism”) and their support for the man who murdered four police officers and wounded a fifth. I hoped that reporting this affront to civilized society would spark action by our so-called leaders to restore civility.

Sadly, I was wrong.

The silence from President Obama – the One, the man who uses his words to calm seas, open the minds of terrorists and drop the Dow like an iron bowling ball – is deafening. Where the hell are the peacemakers? Cindy Sheehan, Code Pink and Rev. Sharpton: Oakland is calling and they’re talking your language.

The San Francisco Chronicle reported “about 60 people marched and rallied in Oakland on Wednesday to condemn the police and honor Mixon.

“OPD you can’t hide – we charge you with genocide,” chanted the demonstrators as they marched along MacArthur Boulevard, near the intersection with 74th Avenue where Mixon, 26, a fugitive parolee, gunned down two motorcycle officers who pulled him over in a traffic stop. He killed two more officers who tried to capture him where he was hiding in his sister’s apartment nearby.

It’s time for the ’60s idiots to snap out of their dope-fueled hazes and take a look around. Four peace officers are dead. Crazies are out in force supporting their killer. This is not OK in a civil society. Got that Obama? How about your terrorist-defending attorney general? Any word out of there?

We’re not only mourning our four police officers, we’re mourning the decay in our society fueled by the left whose motto continues to be power to the peeple – the ones who hate America. They’re looking to spark a revelootion.
